1. Acceptance of Terms
By accessing or using the services provided by WootenHouse ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.
2. Services
WootenHouse provides website design, hosting, and management services for small businesses. Our services include:
- Self-Managed Plan ($49/month + $199 setup fee): A professionally designed website with access to a client portal for self-service content updates.
- Done for You Plan ($129/month + $299 setup fee): A professionally designed website with all content updates handled by WootenHouse.
Setup fees include the first month of service. Monthly billing begins in month two.
3. Payment Terms
All fees are billed monthly via Stripe. You authorize us to charge your payment method on file for all applicable fees. Failed payments are subject to a 7-day grace period. If payment is not received within 7 days, your website may be suspended. Content is retained for 30 days after suspension before permanent deletion.
4. Domain Ownership
You own your domain name. WootenHouse does not claim ownership of any domain registered by or on behalf of the Client. Upon cancellation, you retain full ownership and control of your domain.
5. Content Ownership
You retain ownership of all content you provide, including text, images, and other materials. You grant WootenHouse a non-exclusive license to display this content on your website as part of the service.
6. Acceptable Use
You agree not to use our services to:
- Host content that is illegal, defamatory, or infringes on intellectual property rights
- Distribute malware or engage in phishing
- Violate any applicable laws or regulations
- Harass, abuse, or harm others
WootenHouse reserves the right to suspend or terminate service for violations of this policy.
7. Cancellation
Either party may cancel at any time with no cancellation fee. Upon cancellation:
- Your website will be taken offline at the end of the current billing period
- You retain ownership of your domain
- Content data is retained for 30 days, after which it is permanently deleted
- No refunds are issued for partial months
8. Limitation of Liability
WootenHouse is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless WootenHouse, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of the services or violation of these Terms.
10. Modifications
WootenHouse reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the service constitutes acceptance of modified Terms.
11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.
